What is the most important issue in family law today?
Two recent legislative reforms have significantly changed family law in Australia.
1. Parenting law reforms — effective 6 May 2024
The Family Law Amendment Act 2023 introduced changes to how courts make parenting decisions, including (source: Federal Circuit and Family Court of Australia — Family law changes from 6 May 2024; source: Attorney-General’s Department — Family Law Amendment Act 2023: Factsheet for parents):
- Removal of the presumption of equal shared parental responsibility (this term was often misunderstood as meaning equal time)
- A shorter, simplified list of “best interests” factors that the Court considers when making parenting orders
- Stronger emphasis on child safety and the impact of family violence
- New information-sharing arrangements between courts, police, and child protection agencies under the Family Law Amendment (Information Sharing) Act 2023 (source: Federal Circuit and Family Court of Australia — Family law changes from 6 May 2024)
- A requirement for Independent Children’s Lawyers to meet directly with the children they represent
- New harmful proceedings orders to limit drawn-out, vexatious litigation
These changes apply to new and existing parenting matters where the final hearing had not commenced before 6 May 2024 (source: Federal Circuit and Family Court of Australia — Family law changes from 6 May 2024).
2. Property and financial reforms — effective 10 June 2025
Further changes to the Family Law Act 1975 affect property and financial matters, including (source: Federal Circuit and Family Court of Australia — Property changes from 10 June 2025):
- New considerations relating to family violence and economic or financial abuse
- Updated treatment of companion animals (pets) in property settlements
- Expanded disclosure duties between parties
- Treatment of sensitive information in proceedings
The practical effect of these reforms depends on individual circumstances. If you are involved in a parenting or property matter, or you have an existing order, it can be helpful to obtain advice on how the current law applies to your situation.
