1. Parenting law reforms — effective 6 May 2024

  • Removal of the presumption of equal shared parental responsibility (this term was often misunderstood as meaning equal time)
  • A shorter, simplified list of “best interests” factors that the Court considers when making parenting orders
  • Stronger emphasis on child safety and the impact of family violence
  • New information-sharing arrangements between courts, police, and child protection agencies under the Family Law Amendment (Information Sharing) Act 2023 (source: Federal Circuit and Family Court of Australia — Family law changes from 6 May 2024)
  • A requirement for Independent Children’s Lawyers to meet directly with the children they represent
